Eisch..computors...wrote a long response and the computor kicked me off and then denied me access to the forum.(two days ago).

Ok....as soon as money changes hands, it then becomes a commercial venture.

Should the raffel ticket have "Win an introductory flight for 30 mins", you then use an instructor with all the relevant documentation filed in, it becomes just that...an introductory flight.

Using a normal pilot and something goes wrong and the paperwork is not correct, you could have a legal battle that skriks for nix, with the pax filing law suites against the pilot for negligence.

But, having said the above, I will get the answer from our legal department in writing and post the answer.

Quite honestly, this subject is going nowhere and if the legislation stays the same with all the grey areas it still won't be a clear cut situation. I would like to suggest that the time has come for Raasa to ask for comments pertaining to 'flipping for reward' from the forum and compile a new set of rules, which if you prescribe to or qualify for, or meet the required standards or have the necessary experience, you may flip and charge.

The bit that I appreciate in the past is that if no reg existed CAA would make one up. In this instance it is quite different where they are constructively debating the issue with us.

The AVCOM discussion, particularly the reply from CAA is quite clear. The pilot may not fly for reward. However the passengers can contribite to costs provided the pilot pays his share. So a passenger can pay for half the fuel, provided teh pilot pays his share. I am assuming in this regard there is no difference between PPL and MPL.

As for liability if something goes wrong... When it comes to liability in any event you are only liable if neglegence can be proved, or a participant has been missled as to the dangers. That is where the value of disclaimers comes... if doesn't help you one bit if you are neglegent but it demonstates that you informed the passenger of teh dangers involved. That is why some countries insist on EXPERIMENTAL AIRCRAFT being written down the side.

If you are an instructor or not and you are found to have been neglegent you will be in the same amount of dwang.

That is why investigations into accidents are so sensitive. The investigation can find someone neglegent.
