Is this Legal???

Hi Guys,

I would like to hear your views on the following!

A organisation is busy with his a fund raising drive and they are asking for people to sponsor prizes for the initiative. Would it be legal to offer a "Scenic Micorlight Flight" as a prize. The organization will raffle the tickets, keep all the proceeds and award the prize to the winner drawn.

Obviously there will be terms and conditions to the flight ie: (What can you guys add to the list?)
* Weather dependant!
* Max weight of passenger not to exceed XXX!
* Min age of passenger will be 12!
* Passenger will need to sign a indemnity!
* Passenger will wear a helmet and headset, which will be supplied!
* The pilot will make the go, no-go decision and will not enter into debate with the passenger regarding his call!

In my view, this is the same as taking anybody else for a "Flip". I do not get anything for this except for the satisfaction of introducing someone else to the world of Microlighting.

Geoff at Lightflight has sponsored a few flights for various competitions that I have been involved in. It is labelled as an introductory flight and no one really profits from it.

The legalities - I have no idea. Seems to change with the weather. (We were stopped by CAA a few years ago when we wanted to do flights for a local charity. ) I think there has been a 'softening' since.

Only item would add to your list is that the prize must be redeemed within x months/weeks. Heard of a fellow who wanted to redeem his flight about 18 months after winning and the pilot had sold his aircraft and then had to make arrangements for the prize winner.

To be able to conduct a intro flight - agreed. To do a 'scenic microlight flight' (for no reward) cannot find any evidence in the regs that one cannot do it.

Agree with you SkyBound. In my view it is the same as taking any of my Friends for a flip in the trike?

The operative word here is 'For reward'
The definition of reward again can be debated at length. Another 'grey' area. Mind the 'cuppa' tea.
Maybe Mr Goffel can update us on this issue too.

Yes I agree with the issue "for no reward" as I believe it is the same as taking a mate for a flip. As for the terms and conditions I think it would be wise to stipulate morning or afternoon flight, depending on when and where you fly.
Here in the Kalahari is early morning the only time that is really without bumps.

The pax bought a raffle ticket. So in a way he paid for the flight, even though the pilot/owner of the microlight does not get paid. Might be a legal problem.

Winner should get his initial money which payed for the winning ticket back and get a free flight.
Then if asked the flight did not cost him anything as he got his money back.

good Lord what is this world coming to,

to me the person buying the ticket paid for the ticket and not the flight. People in the past have argued that you can sell a pen for R100 and get a free flight and no one can do anything about that. If the Pilot is not being financially rewarded it is perfectly legal to do this. As long as you have a current Pilots license and are UTD with all the laws and regs as in your AC airworthy stuff then you are fine. IMO

Maybe the pilot should not enjoy the flight or get any satisfaction, because these can be seen as being "rewarded".

But yes I agree, will need to stipulate that it will be a early morning flip!
Agreed that the pilot needs to be current and legal, as with the aircraft as well!

Problem is, If I require a picture of the female PAX, they may want one of the pilot, then you will probably be sh!t out of luck
