EAA Objection to Proposed Regulation on Part 139 Aerodromes

Good day all

We received an email from EAA regarding the Objection of the Proposed Regulation for Part 139 (Aerodromes). This regards all unlicensed airfields.
Please have a look at the link below. It will just take 5 minutes. This regulation will negatively affect majority of aviation in SA... and I believe 99% of everyone on microlighters!

Ladies and gents.... MISASA Exco opted for the diplomatic route to resolve the matter and my e-mails to the Aeroclub shall reflect this. The EAA action is however commendable!

A courteous request from Richard Becker has urged us to request our members to stay cool on this matter until we have had at least one or two meetings with the CAA and see how our proposed changes are accepted. Wild and sometimes offensive statements, will not make for a conducive atmosphere in which to conduct further discussions with the CAA.

Our decision for the diplomatic route I feel is the appropriate action and subsequently re-affirmed by the announcement of Jeff Earle, the Chairman of Aeroclub SA.
Statement from Aeroclub Chairman

Proposed changes to Airfield Status

It has come to the attention of the Aeroclub that certain correspondence has been circulated with proposed changes regarding the Licencing of all airfields. In its present form it signals a devastating blow to the already over regulated & cost spiraling General Aviation.

We are informed that the intention of the changes and the wording are in conflict. It appears that in order to try and PROTECT some of the airfields from being lost to other land uses, this was proposed as envisaged in the NADP. The unintended consequences of some of the wording was not thought through.

Where are we now?

1. Senior sources within the CAA acknowledge that the wording is incorrect, or at the very least poor.
2. At last night’s EAA meeting the matter was put to the floor and discussed at some length.
3. The Aeroclub Chairman and Vice Chairman participated as well as members.
4. Objections to CAA are encouraged in order to stress the gravity of the matter.
5. Aeroclub too will object.
6. The matter has been set down for a meeting with the SACAA before the end of March 2016.
7. If the intention is to ONLY list or register airfields then Aeroclub could see a way of negotiating an acceptable resolution.
8. Aeroclub will vigorously try to elicit an irrevocable undertaking from CAA that this is not just a temporary respite until they see their way clear to implement full blown licencing of airfields.
9. Our fear is that this may just be the thin end of the wedge, for creeping bureaucracy to take over.
10. We need to make CAA aware of the fact that this is our major fear and get appropriate reassurances and undertakings from them.
11. Aeroclub has taken note of the major concerns, and will represent your interests at ALL the forthcoming meetings.

We will advise on the progress of this matter.

I think it is to late for the diplomatic route-my opinion ...

The closing date for for public comment Nico that is.... NOT FOR THE CONSULTATIVE PROCESS which now follows... this whole thing is inevitably going to go back to CARCOM!

WELL I have send misies Sonjani a personal email rgarding this matter, imediately when I first came to hear about this proposed legislation. I dearly hope that she can understand a little bit how economics work because I explained to her that if they go through with this so many people will get retrenched and it will have a domino effect. What I have noticed is that the guys talk about rich game farmers with smart lodges that will be affected thats not true what about the smaller not so rich game famers that doesn't even own a lodge, there many more of them than the rich ones and this no. will increase with this prevailing weather The last time I had rain on my farm was 18 Jan and that was 4mm and our ave. daily temp is 40 deg. I have been feeding my Kudu since end of July till December when we had our first bit of rain. This year I'll probably have to start feeding end of April thats if I can extend my overdraught (**)

Good morning all....

As I suggested previously, the result would be that the matter is referred back to CARCOM for the consultative process ... this has now officially happened!

THE PROPOSED CHANGES TO THE REGS ARE BEING REFERRED BACK TO CARCOM!
Message from the Chairperson of the Aviation Infrastructure subcommittee:
“Following the submission of a proposed Part139 subpart 5 and 6 to the CARCOM process and subsequent to a Subcommittee meeting held during August 2015, CARCOM approved for publication of the said proposals.

Based on the number and content of comments received, a review was done of the proposals in line with international benchmarking as well as the applicable National Development initiatives.

The SACAA also acknowledges industry’s role in the development of new regulations. The conclusion reached was that, we need to review and redraft the proposals in order to provide for better alignment with best practice and development initiatives.

As a result, the AI Subcommittee Meeting scheduled for 17 March 2016 is cancelled and the proposals for Part 139 subpart 5 and 6 will be resubmitted to the CARCOM after a thorough rework”.
