Hi

I am not an attorney but I would say that your only claim would be for the recovery of proceeds from Nic Prinsloo.

He sold your trike on your behalf and it was transferred on papers that you signed so the buyer would be the new legitimate owner.

Shitty one and you will battle to get your money as it would cost more in fees to sue him if you can find him and even then he might have nothing.

Good luck

(Disclaimer - I'm not a lawyer!)
However, I would open a case of Theft under False Pretences.
Although you would need to seek a separate civil judgment against him to get your money back, securing a criminal conviction of fraud/ theft under false pretences may help the gentleman concerned to see the error of his way and realise that the money he pocketed might quite not be worth a criminal conviction and record.

Do you have a formal agreement stipulating the terms of sale? I would contact the new owner to establish his terms of purchase and then lay a charge of theft because otherwise he will do it to someone else.

If you do use a lawyer, restrict his service and get a quote to establish his whereabouts, serve him and define what steps come next and to what extent you will pay for. Avoid their bul$%it "moenie worry, ons sal hom opf@k" and place a ceiling on what you will spend with them coz they like to keep the file 'ticking'.

Often these guys, like builders, come into a fix with suppliers or customers who delay their payment so use other people's deposit or money to bank roll their circumstances but just dig a bigger hole. If he wants to offer a settlement deal, take a car or similar to hold till full payment is met.

I was contacted by another pilot/ aircraft owner that was taken for a R 100 000.

He won a court order against Prinsloo but when the Sheriff arrived at his home to collect - it was empty!

Hell Nic... you should be ashamed of yourself - living the good life whilst others have been taken for a ride!!!
