Legal Information - Criminal Case, not flight related

Hi All

I apologise first of all for bringing such a nasty topic to the forum, I have tried to ensure that it is posted under general so as not to be confused with any flight related discussion, but I am desperately looking for assistance and am posting this on many forums to try and get assistance. I apologise again if this is of no interest to many.

I am looking for someone who may be able to provide some insight into South African Criminal Law regarding the following situation:

I deal with Childline & Bobby Bear foundation (child abuse organisations) in South Africa, and I have come across a situation that requires a bit more legal insight than what I currently have. A young girl (under 18 is all I will say for now, as I don't want the debate to go on about age of consent) has been involved with a man of 24. There are charges (statutory rape) currently being filed against the man. But that is not the issue, we have proof that the Biological mother of the girl, allowed the act to happen and agreed for the girl to spend nights at the mans home.

In the US (and possibly elsewhere), there is a charge called "contributing towards the deliquency of a minor", which can carry a serious term.

My Question: Is there such a charge or similar in South African Law?


I have looked through all the ACTS I have available, and can only come up with the following, but it seems very feeble, so I am hoping someone may know of something more comprehensive to charge the mother with:

CHAPTER 7
GENERAL PROVISIONS


Part 1: Miscellaneous offences: Obligation to report commission of sexual offences against children or persons who are mentally disabled and attempt, conspiracy, incitement or inducing another person to commit sexual offence.

55. Any person who—
(a) attempts;
(b) conspires with any other person; or
(c) aids, abets, induces, incites, instigates, instructs, commands, counsels or procures another person,
to commit a sexual offence in terms of this Act, is guilty of an offence and may be liable on conviction to the punishment to which a person convicted of actually committing that offence would be liable.

Refer the case of Advocate "Barbie" currently running in Pretoria. Same issues. Alternatively, post this under "Non aviation for sale" topic.

Surely 'Childline' and 'Bobby Bear Foundation' have access to the S.A. Legal system via an Attorney, Lawyer or Advocate? I Think that is where you need to be knocking. Not quite the subject for an Aviation Forum.

I suggest you look at the 'new' ages of consent for females in South Africa very carefully. I know for a fact that in the medical field with regard to privacy, 14 is the new 18! Perhaps you will find that she is already at the legal age of consent making your efforts irrelevant.
