Transfer of ownership

Postby johnsa » Sun Oct 19, 2008 5:30 pm

When buying an aircraft you feel an adrenaline rush. But how do you legally obtain problem free owner ship?

1 What documents are involved?
2 Can a bank of the previous owner bite you in the tail?
3 What about outstanding landing fee's?
4 His ex wife who own half of it?

Please share your knowledge

Check on the CAA's web page, I think you will find change of Ownership documents. Ensure that you have the airframe and motor's logbook up to date as well as the last Authority To Fly.

If you or your mates don't know the seller, have a lawyer draw up a purchase agreement. Couple of hundred rands a bargain against a serious headache.

I occasionaly get 'landing fees' from Wonderboom for a trike I sold, which has not even been there.

Only if they have a registered mortgage over the aircraft with the CAA. I think this is the only way the bank can encumber the asset. CAA do have the facility for you to be able to check if a mortgage exists on an aircraft.

1 What documents are involved?
Form CAR47A

2 Can a bank of the previous owner bite you in the tail?
Not unless they have mortgage reg'd with CAA who will not do transfer until bank have signed CAR47A... I hae never finance a plane so I don't know how they work.. (he he not through a lack of trying through   )

3 What about outstanding landing fee's?
You will get the new bills and have to fight it out.....

4 His ex wife who own half of it?
Again CAA will not release CAR47A until registered owners (all of them) have signed. Once took me 17 months to get "partners" to agree to stop fighting amunst themsleves and sign the papers. I did almost 100 hrs on the plane while still reg in their name     .

I have bought with and without contracts. Depend on your circumstances and the plane... I would recommend it and suggest you get PPI done. Money well spent...
